[X] te [Z] (hierna: belanghebbende)
1 Ontstaan en loop van het geding
Aan belanghebbende is over het tijdvak 1 oktober 2013 tot en met 31 oktober 2013 een naheffingsaanslag kansspelbelasting opgelegd.
De Inspecteur heeft bij uitspraak op bezwaar het bezwaar ongegrond verklaard.
Belanghebbende is tegen die uitspraak in beroep gekomen bij de rechtbank Noord-Nederland (hierna: de Rechtbank). De Rechtbank heeft het beroep gegrond verklaard, en de uitspraak van de Inspecteur en de naheffingsaanslag vernietigd.
De Inspecteur heeft tegen de uitspraak van de Rechtbank hoger beroep ingesteld.
Partijen hebben nadere stukken ingediend.
Het onderzoek ter zitting heeft plaatsgevonden op 21 maart 2017. Van de zitting is een proces-verbaal opgemaakt, dat aan deze uitspraak is gehecht.
2 Vaststaande feiten
Belanghebbende is inwoner van Nederland en heeft in oktober 2013 via de website pokerstars.eu deelgenomen aan pokertoernooien, waarbij de pokervariant Texas Hold’em is gespeeld. Belanghebbende heeft hiermee € 8.506 gewonnen.
Op de website pokerstars.eu staat een zogenoemde End user license agreement (ook genoemd Terms of Service; hierna: End user license agreement). Daarin is – voor zover hier van belang – het volgende vermeld:
“This end user license agreement (the “Agreement”) should be read by you (the “User” or “you”) in its entirety prior to your use of PokerStars’ service or products. Please note that the Agreement constitutes a legally binding agreement between you, Rational Gaming Europe Limited (“Rational Gaming”) and Rational Social Projects Limited (“Rational Social”) (Rational Gaming and Rational Social together being referred to herein as “PokerStars”, “us” or “we”).
Rational Gaming is a company registered in Malta (C54266), with registered address at Villa Seminia, 8, Sir Temi Zammit Avenue, Ta’Xbiex, XBX1011 Malta and licensed by the Malta Gaming Authority (CL3/795/2011) pursuant to which it operates the real money poker games (“RM Games”) offered to you on the Internet site found at www.pokerstars.eu (the “Site”). The terms and conditions governing your play on RM Games follow below. Rational Social operates the “play money”/“play for free” poker games (“PM Games”) offered to you on the Site. By entering into this Agreement, you acknowledge that PokerStars is part of a group of companies. As such, where used and the context allows, the term “Group” means PokerStars together with its subsidiaries and any holding company of PokerStars and any subsidiary of such holding company and any associated company with PokerStars including, but not limited to, associated companies providing services under the trade mark “Full Tilt Poker”. In addition to the terms and conditions of this Agreement, please review our Privacy Policy, the Cookie Policy, the PM Games Terms and Conditions, the Poker Rules, the Game Rules, the FAQs, the Sports Betting Rules, the Real Money Processing and Currency Exchange terms and conditions and the VIP Club terms and conditions as well as the other rules, policies and terms and conditions relating to the games and promotions available on the Site as posted on the Site from time to time, which are incorporated herein by reference, together with such other policies of which you may be notified of by us from time to time.
By clicking the “I Agree” button below as part of the software installation process and using the Software (as defined below), you consent to the terms and conditions set forth in this Agreement, the Privacy Policy, the Cookie Policy, the PM Games Terms and Conditions, the Poker Rules, the Game Rules, the FAQs, the Sports Betting Rules, and the Real Money Processing and Currency Exchange terms and conditions as each may be updated or modified from time to time in accordance with the provisions below and therein.
For the purposes of this Agreement, the definition of “Software” will include the PokerStars poker software downloadable to your personal desktop or laptop computer (“PC”) from www.pokerstars.eu (the “PC Software”) and the PokerStars mobile software application (the “Mobile Software”) downloadable to a mobile device (including, without limitation, a cellular phone, PDA, tablet, or any other type of device now existing or hereafter devised) (each, a “Device”) as well as all ancillary software to the poker software (whether web-based software or client/server software).

In de End user license agreement is bepaald dat Maltees recht van toepassing is, waaronder de Remote Gaming Regulations en de antiwitwaswetgeving. Voorts is bepaald dat het saldo van een slapende of inactieve rekening naar de Maltese kansspelautoriteit, de Malta Gaming Authority, wordt overgemaakt indien het niet lukt om contact te krijgen met de houder van deze rekening.
Rational Gaming Europe Ltd. is statutair gevestigd in Malta en is daar ingeschreven in het bedrijfsregister. De vennootschap heeft een licentie haar bedrijf uit te oefenen op grond van de Maltese Remote Gaming Regulations. De licentie, een “Class 3 on 4 licence” (nr. LGA/CL3/795/2011), is verstrekt door de Malta Gaming Authority. Op de website van laatstgenoemde autoriteit staat over een “Class 3 on 4 licence”:
“It is also possible to have a Class 3 on 4 licence whereby the Class 3 licensee operates its games on the software and in certain cases through the equipment of a Class 4 licensee.”
Rational Networks Ltd., een dienstverlener van netwerkdiensten, is statutair gevestigd in Malta en daar ingeschreven in het bedrijfsregister. Rational Networks Ltd. heeft een “Class 4 licence” (nr. LGA/CL4/795/2011) van de Malta Gaming Authority.
Rational Gaming Europe Ltd. en Rational Networks Ltd. behoren tot een concern dat in 2013 uiteindelijk wordt gehouden door Oldford Group Ltd. Oldford Group Ltd. houdt alle aandelen in Rational Group Ltd., een vennootschap die haar statutaire zetel en feitelijke leiding heeft in Isle of Man en aan het hoofd staat van de Rational Group. De Rational Group bestaat uit een groot aantal (dochter)vennootschappen in meerdere vestigingsplaatsen, onder meer in Isle of Man, Ierland, het Verenigd Koninkrijk, Frankrijk, Spanje, Italië, Australië, Costa Rica en Malta. De Rational Group exploiteert een aantal pokermerken, waaronder PokerStars. Rational Group Ltd. sluit onder andere contracten met partners, die nieuwe klanten aanbrengen. Tot het concern behoren voorts onder andere Rational Social Projects Ltd., Rational Entertainment Enterprises Ltd. (die de website pokerstars.com exploiteert) en Rational Services Ltd. (die onder meer endorsement contracten sluit met personen die diverse promotionele activiteiten verrichten). De laatstgenoemde vennootschappen zijn alle gevestigd in Isle of Man.
3 Geschil
In geschil is of de aanbieder van het gelegenheid geven tot het spelen van poker in een lidstaat van de Europese Unie (i.c. Malta) is gevestigd, wat belanghebbende stelt en de Inspecteur bestrijdt.
